Abstract

LEGAL PROTECTION FOR MIDWIVES IN CLINICS
BASED ON LAW NUMBER 17 OF 2023 CONCERNING HEALTH

ABSTRAC

Health is a person's human right and one of the elements of prosperity that must be realized with the ideals of the Indonesian nation. In carrying out life, every person has the right to obtain general and adequate health services. Health efforts that are said to be successful can be seen from the availability of health resources in the form of health personnel, facilities and infrastructure in adequate quantity and quality. Legal protection is any effort that can guarantee legal certainty, so that it can provide legal protection to the parties concerned or those taking legal action. As health workers, especially midwives, in carrying out their practice, they are obliged to provide health services in accordance with professional standards, professional service standards, standard procedures. Protection Midwives in carrying out midwifery practices have the right to obtain legal protection as long as they carry out their duties in accordance with their competence, authority and comply with the code of ethics and standard operational procedures. Carrying out actions outside of authority or not taking action in accordance with authority which results in losses can enter the realm of law. Based on the research results, it was concluded that midwives who provide health services that do not comply with SOPs, violate the code of ethics and violate legal acts will receive administrative sanctions, even criminal sanctions. Administrative sanctions in the form of verbal warnings, written warnings, proposed dismissal of STR and SIPB and proposed dismissal of their positions. So that something undesirable does not happen, midwives as health workers must work in accordance with their authority based on applicable laws.
