LEGAL PROTECTION FOR TRAFFIC USERS AND DAMAGED ROAD TRANSPORTATION IN JOMBANG REGENCY

By seeing the frequent occurrence of traffic accidents on highways, whether on district highways, provincial highways or national highways, and most people, especially those who experience accidents, where the cause is because the highway is damaged, do not know what to do regarding the government's legal responsibility for victims of road accidents caused by damaged roads.
On this occasion the author would like to discuss the importance of legal protection for people who experience traffic accidents due to damaged roads. The background of this study is traffic accidents due to damaged roads, where these accidents often occur to everyone, especially motorcyclists, especially in the Jombang Regency area of East Java Province.
The main problem in this study is, what legal provisions can be used to provide legal protection for people who experience accidents due to damaged roads, and what factors are obstacles in providing legal protection for victims of traffic accidents. The approach method in this study uses normative law, this study focuses on normative law and secondary data as the main data and uses primary data as supporting data. The data sources in this study were obtained through literature reviews and field studies. Both data were processed using qualitative analysis. Based on the analysis that has been carried out by the author, it can be concluded as follows: the legal provisions that provide legal protection for road users who experience accidents due to damaged roads are the 1945 Constitution and Law Number 22 of 2009 concerning Traffic and Public Transportation, and the obstacles in providing legal protection for victims of traffic accidents are the lack of police officers, the lack of facilities and infrastructure that support police activities, and the low awareness of victims to report accidents in order to obtain legal protection from the government.
