ANALISIS HUKUM TERHADAP PENYALAHGUNAAN DAN PEREDARAN NARKOBA DI JOMBANG JAWA TIMUR (STUDY KASUS DI DESA MAYANGAN JOGOROTO)

Narcotics abuse continues to increase from year to year, not only among adults but also among teenagers and children. The causes of this abuse consist of two factors, namely internal and external factors. With these problems, this research aims to determine the regulation of criminal sanctions against narcotics abuse and determine the application of criminal sanctions against narcotics abuse. This research uses a normative method. The data sources used are secondary legal material sources obtained through document analysis, and legal material analysis using legal argumentation. The research results show that the regulation of sanctions for narcotics abuse is regulated in Law Number 35 of 2009 concerning Narcotics articles 111 to 148. Criminal sanctions for narcotics abuse are in the form of imprisonment and fines. The criminal system for narcotics abusers uses a double track system, namely applying criminal sanctions and action sanctions at the same time.
Law is an effective tool to protect people from actions that endanger themselves, such as illicit trafficking and narcotics abuse. The circulation of narcotics among teenagers is influenced by internal and external factors. Psychologically, adolescent behavior is still unstable so they are still easily influenced by the surrounding environment.
