Abstract
LEGAL ANALYSIS OF FACTORS CAUSING THE HIGH DIVORCE RATE IN JOMBANG REGENCY

The high divorce rate in Jombang Regency is a social issue that requires serious attention. Divorce is often triggered by internal factors, such as economic problems, persistent disputes, and domestic violence (KDRT), as well as external factors, such as infidelity and a lack of preparedness among young couples. Data shows that the majority of divorce lawsuits are filed by wives, citing economic reasons as the dominant cause. This phenomenon also negatively impacts children, who often experience psychological stress. This study used a normative legal approach with a desk research method. Data were collected through analysis of legal literature, laws and regulations, and reports from the Jombang Regency Religious Court. Qualitative data analysis techniques were used to understand the interrelationships between various factors influencing divorce. The results indicate that economic instability, a lack of understanding of roles in marriage, and minimal premarital education are the main factors increasing the risk of divorce. Efforts to reduce the divorce rate include counseling, economic empowerment, premarital education, and family counseling services. Additionally, mediation in religious courts is implemented to provide opportunities for reconciliation. This study recommends a holistic approach encompassing education, economic policy, and law enforcement to reduce the divorce rate and improve family harmony in Jombang Regency.
