Abstract

A Notary, as a public official who carries out the profession of providing legal services to the public, needs to receive protection and assurance to ensure legal certainty. The guarantee of protection and legal certainty for the implementation of a Notary's duties has been regulated in the Notary Position Act No. 2 of 2014. As a public official, a Notary has the authority to create authentic deeds and is appointed and dismissed by the Minister, but is not a civil servant. The rapid development of digital technology has changed the way various professions, including Notaries, market their services. Promotion of Notaries through digital platforms has become an efficient method of reaching potential clients in today's modern era. This study uses a normative juridical method with a legal approach (status approach).
Forms of promotion that violate regulations, such as excessive or result-guaranteeing promotion, the use of social media to aggressively advertise Notary services, and promotions that mislead the public regarding the capabilities or range of services offered, have become issues. The promotion of Notary services through digital platforms has become one of the preferred marketing strategies for Notaries in facing technological developments and the public’s need for easy access to information.
As a form of protection for the public and to maintain the dignity of the profession, the Regional Supervisory Council is responsible for overseeing and enforcing regulations through inspections, investigations, and imposing sanctions on Notaries who violate provisions in the Notary Position Act. Sanctions may include warnings, reprimands, or even revocation of the practice license for Notaries who commit serious violations. However, with the increasing use of digital media, problems arise regarding the alignment of Notary promotions with the provisions of the Notary Position Act, which regulates behavior, codes of ethics, and prohibitions within the Notary profession.
The research findings indicate that while digital promotion provides significant opportunities for Notaries to expand their market reach, there are several aspects that must be considered to ensure that such promotions do not conflict with the ethical principles and regulations outlined in the Notary Position Act, such as prohibitions against commercial or excessive promotion. Therefore, it is important for Notaries to understand and comply with the limitations established in the Notary Position Act so that digital promotions can be conducted legally and ethically.
