TINJAUAN YURIDIS SANKSI PIDANA TERHADAP PELAKU PENCEMARAN NAMA BAIK DI MEDIA SOSIAL DALAM PERSPEKTIF UNDANG-UNDANG INFORMASI DAN TRANSAKSI ELEKTRONIK (UU ITE)

Indonesia is a democratic country with demands that are emphasized by society towards openness, flexibility and urgency of information are very large. The digital era that emphasizes the advancement of information technology, electronic media and globalization occurs in almost all aspects and elements of life. One of them is the emergence of the internet which is used to access many information media. The presence of social networks in social media brings a radical form of change in communication, people in it tend to be free to express their opinions or emotions, but what needs to be underlined is that ethical standards or good and correct attitudes in interacting must still be emphasized, because errors in interacting result in criminal sanctions. The Republic of Indonesia has guaranteed this through the Electronic Information and Transactions Law, which is a provision that applies to anyone who commits a legal act, including defamation in Article 27 Section (3) and Article 45 Section (3) of the Electronic Information and Transactions Law (UU ITE), both within the territory of the Republic of Indonesia and outside the territory of the Republic of Indonesia which is detrimental to the interests of Indonesia. This thesis is entitled Legal Review of Criminal Sanctions Against Defamers on Social Media in the Perspective of the Electronic Information and Transactions Law (UU ITE). In the discussion of this thesis, the author tries to raise the provisions regulated in Article 27 section (3) and Article 45 section (3) of the Electronic Information and Transactions Law (UU ITE) which provide legal protection to the public in the event of defamation on social media and Article 27 section (3) and Article 45 section (3) of the Electronic Information and Transactions Law (UU ITE) are in line with the principles of justice in criminal law. The research method in this thesis is normative legal research with and analyzing existing legal materials. The legal basis and legal considerations for applying sanctions to perpetrators of defamation are reviewed using Article 27 section (3) and Article 45 section (3) and then continue to use the basis of Article 310 of the Criminal Code.
