PERAN MAJELIS PENGAWAS NOTARIS DAERAH (MPN) DALAM MELAKSANAKAN PEMBINAAN DAN PENGAWASAN NOTARIS DI KABUPATEN JOMBANG

The legal profession is a profession that prioritizes moral values embedded in
every person to maintain the dignity of their profession. One of the bearers of the legal
profession is a Notary as a public official who is authorized to make authentic deeds
and has other authorities regulated in the Notary Law. Deviations are often found by
certain notaries. If the deviation extends from its ideal form, it will result in the decline
of public trust in Notaries. Based on this description, the author is interested in
researching the Role of the Regional Notary Supervisory Board in Implementing
Notary Guidance and Supervision in Jombang Regency.
In this study, the problems raised are how the Implementation of Guidance and
Supervision of the Regional Notary Supervisory Board of Notaries in Jombang
Regency, and how the Role of the Regional Notary Supervisory Board in the guidance
and supervision of Notaries in Jombang Regency. This study uses a normative legal
research method, namely literature review and unstructured interviews.
Implementation of guidance and supervision of the Regional Supervisory Council
for Notaries of Jombang Regency related to 3 things, namely the existence of complaint
reports from the public, examination of Notary protocols, and examination of other
legal facts. Examination of Notary protocols includes Minutes of Deeds, Books that
support Notary archiving based on provisions of laws and regulations, the Supervisory
Team must also examine the Notary Office Facilities and Infrastructure, Notary
Appointment Letters and Minutes of Oath of Office, Notary leave permit certificates
and Notary leave certificates, Archive conditions, Deed storage conditions, Monthly
reports, Random tests on deeds, and Number of employees.
Supervision carried out by the Notary Regional Supervisory Board is important
because it plays a very important role in the process of coaching and supervising the
performance of Notaries in order to minimize errors and violations in carrying out
their duties, especially in coaching and supervising the Notary Regional Supervisory
Board of Notary protocols as routine monitoring and evaluation. More precisely, the
role of the Notary Regional Supervisory Board is to oversee the enforcement of Law
Number 30 of 2004 and its Amendments, namely Law Number 2 of 2014 concerning
the Position of Notaries and the Notary Code of Ethics. On the other hand, the role of
the Notary Supervisory Board is to improve services and legal protection for the
community using notary services.
