Abstract
The electronic auction system (e-catalog) in government procurement of goods and services (PBJ) aims to increase efficiency, transparency, and accountability. However, its effectiveness remains a matter of debate. This study analyzes the effectiveness of the e-catalog legal provisions in increasing the efficiency and transparency of the Procurement of Goods and Services, as well as the influence of contract cancellation/adendum on the effectiveness of the procurement system and principles. This study uses qualitative methods with data from interviews with government procurement managers, an analysis of corruption cases related to e-catalogs, and a literature review. The results show that e-catalogs have the potential to improve the efficiency and transparency of procurement, but there are challenges. The first challenge is price inequality. Although e-catalogs provide price information, listed prices are often higher than market prices. This is caused by price inflation by suppliers, inadequate quality of goods, monopolistic pricing practices, and a lack of oversight. Price inequality can lead to waste of state funds, inadequate quality of goods, decreased public trust, and increased corruption. The second challenge is contract cancellation/addendum. Contract cancellation can occur due to force majeure, breach of contract, or provider failure. Contract cancellation can hinder efficiency and transparency, and affect accountability. Contract cancellation regulations that grant extensive authority to the Commitment Making Officer (PPK) to terminate contracts can create potential unfairness for service providers. To address this issue, this study recommends improving the price monitoring and control system by establishing an independent monitoring team and developing a price anomaly detection feature. Furthermore, fairer regulations are needed for contract cancellation and addendums, including transparent and fair procedures for both parties, as well as compensation policies for providers who suffer losses. With these improvements, the effectiveness of the e-catalog can be optimized, maintaining the principle of fair competition in government procurement of goods and services.
