Abstract

THE ROLE OF PROSECUTORS IN CORRUPTION CASES BASED ON THE CORRUPTION ERADICATION LAW

ABSTRACT

The role of the Prosecutor’s Office in handling corruption cases is closely related to several applicable legal provisions, where prior to prosecution, the Prosecutor’s Office conducts investigative efforts and examinations of suspect. This study aims to analyze the role and authority of prosecutors in corruption cases based on the prevailing laws, as well as to identify the factors that hinder prosecutors in exercising their authority. The research method employed is normative legal research, utilizing a statute approach and library research. The findings of this study indicate that the role of prosecutors in corruption cases includes function as investigators, and prosecutors (Articles 26 of Law Number 31 of 1999), as well as executors of court decisions. The authority held by prosecutors includes the abily to performs legal actions such as wiretapping, seizure, detention, and arrest (Articles 7 Paragraph (1) of the Criminal Procedure Code). The obstacles faced by prosecutors consist of internal challenges including the quality of human resources and complex governments, as well as external challenges such as political intervention and negative stigma from society. This study recommends the need for improvement goals, as well as as the necessity for legal system reforms that focus on corruption prevention while considering the applicable principles and norms.
